I recently reviewed my credit profile and noticed inaccuracies and false accusations and fraudulent accounts. I am formally requesting that these be investigated properly with immediacy. This is my second time asking these credit agencies LLC to remove these collections : XXXX XXXX XXXX, Account # : XXXX XXXX XXXXXXXX XXXX XXXXXXXX, balance claimed owed {$7800.00}, Account # : XXXX XXXXXXXX XXXX XXXX, balance claimed owed {$1100.00} These agencies is in violation of 15 USC 1692g. They were to notify me of this in writing 5 days prior, I was not notified. As the original creditor, only I can validate this debt. I do not validate this debt. The reporting of these account ( s ) is/are violations of 15 USC 1681 , and the Fair Credit Reporting Act [ 15 USC 1681 ( a ) ( 2 ) ( B ) ] : ( 2 ) EXCLUSIONS. They were to notify me of this in writing 5 days prior, I was never notified as the original creditor, only I can validate this debt. Therefore, the following accounts must be deleted from my reports immediately. In accordance with the Fair Credit Reporting Act ( FCRA ) the following accounts, they have violated my rights 15USC 1681-602A states I have the right to privacy ,15USC 1681-604A Section 2 : It also states a consumer reporting agency can not furnish an account without my written consent and instructions. I am not liable for this collection they have not provided me with the original contract as I have requested several times. 15 USC 1681 ( a ) ( 2 ) ( i ) states transactions and experiences between the consumer and the person making the report are not included in the " consumer report ''. By Law, the IRS defines a charge off accounts as cancelled debt that you have to pay taxes on meaning the charge off accounts are now earned income for me the consumer. Collections & Charge offs accounts over {$600.00} reporting to my consumer report is tax fraud. By Law companies are supposed to send me the consumer a copy of the 1099 from the accounts that has been charged off written as loss. The collection is now income by IRS law states that income can not be reported as debt. Please remove this account from my report this is against the law and is considered tax fraud. The account information listed directly above is inaccurate, and I dispute the validity of each. As per the FCRA you must delete all entries to my credit file that can not be proven to be accurate. Likewise, you must provide me with your Method of Verification. You are a partial owner of the eOscar system, which has proven to be unreliable for the intended purpose of my dispute and does not constitute the legally required independent investigation that you must conduct. For clarity, the sections of the Fair Credit Reporting Act of 1970 which are referenced within this letter are : Section 604, Section 609, Section 611, and Section 623. I will assume that by the very nature of your business, I do not need to provide definitions of what is covered under each of these sections individually. The Information as Shown Below Must Be Investigated Immediately. Failure to Provide Adequate Details, Method Of Verification, Accuracy Of All Dates, Amounts, and other pertinent information will result in the immediate filing of formal complaints with the CFPB and the FTC. I reserve my right to sue you civilly in the court system, which will result in my seeking the maximum allowable penalty for each item. As per the Fair Credit Reporting Act of 1970, I am requesting that when responding to this dispute, you show the Method Of Verification you have used in determining the accuracy of the above listed information. I do not consent to the use of E-Oscar as a verification method. I am aware that the FCRA provides you ( 30 ) days to investigate these items, and ( 15 ) days more to provide me with your findings. I do expect that you will also provide me with an updated copy of my credit report. Upon completion of your investigation, which will show any changes or the lack thereof. I expect these results to include all information requested, including your method of verification. If you are unable to comply within the confines of the FCRA, I will expect all items to be promptly deleted. I have read that you will often label a dispute as frivolous, with an accusation of the use of a credit repair company. Rest assured, I have entirely composed this letter myself, without the assistance of a credit repair company. Should I require assistance, it will be sought through an attorney, dependent on your response to this letter. Thank you very much for your cooperation.
