Consumer Financial Protection Bureau 1700 G Street NW Washington, DC 20552 Subject : Complaint Against TRANSWORLD SYSTEMS Inc. and XXXX XXXX XXXX XXXX XXXX Regarding Violation of Privacy and Debt Collection Practices To Whom It May Concern, I am writing to formally lodge a complaint against TRANSWORLD SYSTEMS Inc. ( TSI ), a debt collection agency, and XXXX XXXX XXXX XXXX XXXX the main creditor, concerning their handling of my alleged debt and the resulting negative impact on my credit report. This complaint is pursuant to the privacy and consumer protection guidelines established under PART 1016 - PRIVACY OF CONSUMER FINANCIAL INFORMATION ( REGULATION P ), particularly referencing 12 CFR 1016.1, 12 CFR 1016.4, 12 USC 531, and 15 USC 6802, in addition to the Fair Credit Reporting Act ( FCRA ) provision 15 USC 1681i. I request that the following documents be provided to me within 30 days from the date of this complaint : 1. Purchase Agreement : A copy of the purchase agreement between XXXX XXXX XXXX XXXX and TSI, reflecting the details of the transaction for the alleged debt. 2. Original Contract : A copy of the original contract with XXXX XXXX XXXX XXXX. that includes my signature and details of the agreement, confirming that XXXX XXXX XXXX XXXX did not simply sell the debt but assigned it to TSI with all the attendant obligations and rights. 3. Form 1099 : A detailed Form 1099 showing the full payment history and a breakdown of the alleged debt, with explanations for each line item, date of purchase, receipt of goods, and other relevant details. 4. Date of Last Activity : The date of the last activity on the account, which is crucial for proper validation of the debt, and a letter of sale or assignment from XXXX XXXX XXXX XXXX XXXX TSI. in light of the Spears v. Brennan case : Moreover, I must emphasize the legal imperative, as established by the case Spears v. Brennan, 745 N.E.2d 862 ; 2001 Ind. App. LEXIS 509, which mandates that debt collectors provide consumers with comprehensive documentation of their indebtedness, including the original contracts and terms of agreement. TRANSWORLD SYSTEMS Inc. 's failure to provide me with the necessary documentation detailing the nature and terms of the alleged debt contravenes this legal standard. I hereby insist upon a prompt and thorough validation of this debt, which must include all contracts or documentation that substantiates the alleged indebtedness. In the event that TRANSWORLD SYSTEMS Inc. can not provide such validation in compliance with the law, I demand the immediate removal of the disputed account from my credit report and an end to all collection activities related to this matter. Given that both TSI and XXXX XXXX XXXX XXXX issue XXXX and bonds and engage in the purchase of contracts which are considered purchase money loans, it is imperative that they adhere to the Uniform Commercial Code ( UCC ) and consumer protection laws related to contracts and debt collection. I expect a prompt and detailed response to this complaint, including the provision of all requested documentation. Should TSI be unable to validate the debt or fail to adhere to the aforementioned regulations and legal obligations, I demand that the entry be removed from my credit report immediately, and any further collection attempts be ceased.
