My loan was in default in 2010 due to the great recession and housing market crash. My HOA foreclosed and the property was vacant for 2 years. My mortgage servicer sent me a letter saying I was approved for a loan modification, on the condition that I successfully made XXXX trial modification payments and entered credit counseling. First I had to buy back the property from the XXXX, the new owner, which I did at great expense to me, relying on the lender 's promises. I did everything that was required of me. After 9 months of accepting my payments, I received a letter saying I was not eligible for the modification because the property " is '' vacant. I actually lived in the property, they were mistaken. They told me I owed all the back payments, including the forebearance amount they reversed, or I would be in default. I appealed this decision. They illegally entered my property ( trespassed ) while I was at work, with no notice and no warning, and no foreclosure pending, and changed the locks. They locked my pets inside and me out. Then they refunded all my payments, forcing me into default, filed a new foreclosure action. They made the mistake, and they have admitted they made the mistake. They knew the property had been vacant before the modification because the offer letter was sent to a different address than the property address AND they had been making periodic/monthly? inspections of the vacant property for 2 years. My position is that if a mistake was made, it was the lender 's mistake and not my mistake and I should not be penalized. We have been fighting over this for XXXX years now. Now they have demanded repayment of the principal, interest and all the litigation expenses they have incurred as a result of THEIR mistake and my attempt to get them to reinstate the modification. The balance that started as {$99000.00} is now over {$170000.00} through no fault of mine. They refuse to negotiate in good faith to resolve THEIR mistake.
