Consumer Narrative

Last Complain made to CFPB by Mail on XX/XX/XXXX By mail Tracking # XXXX Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX Washington XXXX DC, XXXX To Whom It May Concern : I am writing to bring to your attention a matter regarding an unauthorized inquiry on my consumer report, which occurred on XX/XX/XXXX, and XX/XX/XXXX involving XXXX XXXX XXXX, XXXX, XXXX XXXX and Equifax. It has come to my attention that inaccurate, incomplete, and unverifiable information is being reported by XXXX XXXX XXXX, XXXXXXXX XXXX XXXX and Equifax. Since XX/XX/XXXX, I have diligently corresponded with Equifax, providing various letters requesting an investigation into these inquiries. Alongside these letters, I included documentation such as my XXXX letter, proof of address, and bank statements. Despite multiple attempts and reminders, Equifax failed to respond within the mandated 30-day period stipulated by the Fair Credit Reporting Act ( FCRA ). Repeated attempts to address the issue directly with Equifax yielded unsatisfactory responses, with requests for a police report or redirection to the lender. Upon contacting XXXX XXXX XXXX, I was informed that all my information had been purged from their records, and they assured me that they would not share my personal information with any entity. However, subsequent inquiries with other entities named XXXX and XXXX XXXX revealed they had no record of my requests nor any information pertaining to me. It has become apparent that XXXX XXXX XXXX initiated four inquiries ( Two with XXXX XXXX one with XXXX and one with XXXX XXXX XXXX ) under my name without my explicit authorization. Despite my insistence that they cease sharing my information, they asserted it was not possible. Even when I cited the law that explicitly prohibits such actions without consent, their response was a screenshot lacking any valid signature, date, or IP address associated with me. ( Documents attached ) I wish to emphasize that I have not engaged in any transactions with XXXX XXXX XXXX, or XXXX XXXX XXXX, nor do I maintain any accounts with them for review or collection purposes. The actions of these entities constitute a serious breach of privacy and potentially amount to Aggravated Identity Theft, as defined by 18 U.S.C. 1028A. Their unauthorized access to my personal information is not only a violation of the FCRA but also poses significant legal implications, both criminally and civilly. Under 15 U.S.C. 1681n ( a ), any party found to have obtained consumer information under false pretenses is subject to fines and imprisonment. Furthermore, their conduct directly contravenes FCRA regulations by unlawfully accessing my Equifax consumer report without authorization or permissible purpose. FCRA sections 604 ( f ) and 619 explicitly prohibit the unauthorized use or acquisition of consumer reports and impose criminal liability on those who do so under false pretenses. The repercussions of their actions extend beyond mere inconvenience. I have been unjustly denied access to new credit opportunities and experienced difficulties in obtaining increases in lines of credit due to their willful disregard for FCRA provisions.
