This is concerning a complaint I already made, but since I cant upload new documents to a former complaint, Im starting a new one. Midland funding LLC is threatening wage garnishment from a debt they bought. This debt was from a XXXX XXXX credit card. The card was officially closed on my credit as of XX/XX/XXXX, which means capital one has charged it off on their taxes, being XXXX XXXX XXXX, but somehow this 3rd party Midland Funding LLC is still trying to come after me for it. The document provided for the wage garnishment only has the name of the municipal court but isnt actually a court document. Its stating that Midland was coming after my wages and was only signed by the creditor, but no signage from a court official. This is the only documentation I have received regarding this very old account. I have a screenshot of my credit report saying the date of closure was XXXX, but the lady from midland said the account didnt go delinquent until XXXX. She was rude and spouted off a bunch of information at me but wouldnt listen to me when I told her I believe her reporting information was incorrect. She said it wasnt illegal to buy debt, but I believe consumer law states that once a debt is charged off from one creditor, its illegal for another to come after you for it. Statute of limitations where I live is 6 years but its been almost 8. This account is no longer reported on my credit either.
