On Monday, XX/XX/XXXX, I deposited a check drawn on the XXXX XXXX XXXX XXXX in the amount of {$55000.00} in my account with Capital One, with the expectation that the monies would be available on Tuesday, XX/XX/XXXX in accordance with the provisions of implementing Regulation CC. In subsequent conversations with representatives of Capital One, they advised me that a certain amount would be available on Tuesday, XX/XX/XXXX, but that the full amount would not be available for four ( 4 ) business days for " security reasons ''. When I pointed out that the check was drawn on another financial institution and that the only way a bank check could be returned is if it is lost and/or stolen and that because it was being deposited into account with the same as the check payee, and therefore was neither lost nor stolen, their " security reason '' was without merit. I requested that the matter be escalated and that I receive a call back, but I have neither received a call back, nor has the full amount of my check been made available.
