I have repeatedly sent letters to the creditor Brite Financial. I have sent multiple letters requesting to exercise my right to opt out and the company never responded last letter was sent XX/XX/XXXX. The account is reporting as a charge off which means the company received a tax break on the debt which now makes the debt a certificate of indebtedness. Per the IRS Publication 4681 states reporting cancelled debts as income, Generally canceled debts must be reported as income on your tax return, and you may receive a form 1099-c from the creditor reporting the canceled debt amount to the IRS and to you. I have not received a 1099c from Brite Financial. I have also sent a letter to opt out of the account reporting. The company continue to report the account disregarding the letter I as the consumer sent to opt out. This is also a violation of the Privacy Act of 1974 which aims to protect rights of individuals by regulating how federal agencies collect, maintain, use, and disclose personal information, including provisions related to sharing personal information to third parties. Brite Financial stated they will not share my information with any third party affiliates but yet the credit reporting agencies have my information without my consent.
