I am writing to file a complaint with the Consumer Financial Protection Bureau ( CFPB ) against Experian, a consumer reporting agency, for serious violations of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681. On XX/XX/2024, I received a copy of my credit report from Experian. I reviewed the credit report and was astonished to find that Experian had reinserted a fraudulent account from XXXX XXXX XXXX XXXX after it had been deleted. This reinsertion of the fraudulent account is a clear violation of federal law. Under 15 U.S.C. 1681c-2, Experian is prohibited from reporting accounts that result from identity theft on my consumer report. I previously filed a police report, and I also provided Experian with a copy of the Identity Theft Report issued by the Federal Trade Commission ( FTC ). The willful noncompliance of Experian with FCRA guidelines is evident. 15 U.S.C. 1681 ( c ) ( 2 ) clearly states that Experian shall not report accounts that result from identity theft by a person who has furnished appropriate proof of such theft to the consumer reporting agency. Experian 's actions are not only unlawful but also damaging to my financial well-being. The fraudulent account negatively impacts my credit score and financial opportunities. I hereby request that Experian immediately delete the fraudulent XXXX XXXX XXXX XXXX account from my consumer report. Furthermore, I demand appropriate and timely compensation for the damages caused by Experian 's willful noncompliance with FCRA guidelines. Thank you for your prompt attention to this matter.
