I invested into to Capital One Auto Finance XX/XX/year>. ( acct # XXXX ) The means of investment was an extension of credit. The instrument that was used to extend me credit was an application. That application that I filled out and provided to them was a SECURITY. Per their Prospectus report, filed wit the SEC, they stated that they transferred and securitized my security, which is COMMINGLING and SECURITY FRAUD! The {$10000.00} balance posted on my consumer report is INTEREST OWED TO ME!!! I sent them MULTIPLE LETTERS REVOKING THEIR POWER OF ATTORNEY, and didn't get a response. The information posted on my consumer report is FALSE and MISLEADING. Due to this FALSE and MISLEADING information, it shows that you are not properly performing the duties quoted in your indenture, thus you are BREACHING YOUR COVENANT and FAILING TO PERFORM YOUR FIDUCIARY DUTY. The Indenture Trustee and Issuer are required to perform as specified within the Indenture. Capital One Auto Finance also stated that they wouldn't list notes on any exchange, However this is more FALSE and MISLEADING information. I have gotten a CERTIFIED FINANCIAL SECURITIZATION AUDIT done on my account and I PROOF that they are trading on the SECONDARY MARKET!! I have gathered ALL of the Necessary information to pursue Litigation.
