This complaint is in response to an initial CFPB complaint XXXX regarding sold accounts being continuously reported by COMENITY BANK XXXX COMENITY BANK stated that they have verified that they are lawfully and accurately reporting the accounts that they have sold to XXXX XXXX XXXX XXXX on my credit reports and refused to remove the accounts. I believe this is both false and damaging to my credit report and reputation. According to the Fair Credit Reporting Act ( FCRA ) the information must be accurate and up to date. The FCRA emphasizes fairness and accuracy of credit reporting under section 605 of the Fair Credit Reporting Act ( FCRA ). It is not fair nor is it accurate to report an account when the account no longer belongs to you. This would make the reporting of the account inaccurate and abusive. A violation of 15 USC 1692s-2 ( a ) ( 1 ) ( a ). This a clear tactic to keep me from challenging the debt with the debt collector during the debt validation process because you are still reporting the account on my credit report. This behavior is deceitful and there are in fact penalties for such behavior. This is a violation of the Fair Credit Reporting Act and a violation of the Fair Debt Collection Practices Act. Lastly, I did not receive a letter from you in the mail responding to my previous attempt to dispute. Please provide the certified tracking number and receipt with my name and or signature on it as proof of such communication. My dispute letters were delivered XX/XX/2024. It has been over a month, and the initial complaint through the CFPB per the complaint number referenced was our first time communicating. I did not receive any disclosure, updates, results, or any response whatsoever regarding the investigation you allegedly performed when I mailed off letter to dispute the accounts on XX/XX/2024. Here is the certified tracking number showing proof that I did dispute the accounts : # XXXX XXXX XXXX XXXX XXXX XXXX and # XXXX XXXX XXXX XXXX XXXX XXXX. Please provide me the information of how you verified these accounts and that you are reporting this account accurately in accordance with the Fair Credit Reporting Act. Creditors typically remove accounts they have sold to collections otherwise it would be out of compliance for inaccurate reporting. Reporting false information deliberately is also an act of fraud 18 USC 1001.
