Good Morning, Im requesting your assistance in obtaining relief through the Military Lending Act ( MLA ). American Express refuses to refund me for a {$550.00} annual that I paid, stating that I am not entitled to MLA relief. Enclosures ( XXXX ) to ( XXXX ) are furnished in order to support my request. I applied for the American Express XXXX XXXX XXXX XXXX on or about XXXX XX/XX/XXXX and received an e-mail confirmation ( encl. ( XXXX ) ) that my application was approved. In XX/XX/XXXX, I received a monthly statement for the subject credit card ( encl. ( XXXX ) ), which included a {$550.00} annual fee. Per American Expresss MLA page ( https : //www.americanexpress.com/us/help-support/service-members-civil-relief/ ), A regular or reserve member of the Army, Navy, Marine Corps , Air Force , or Coast Guard , serving on active duty under a call or order that does not specify a period of 30 days or less, or such a member serving on Active Guard and Reserve duty as that term is defined in 10 U.S.C. 101 ( d ) ( 6 ). Per encl. ( 3 ), I was on Active Duty for Operational Support Orders for over 30 days, from XXXX XX/XX/XXXX to XXXX XX/XX/XXXX. Additionally, I was executing this set of orders when I opened the account. At any rate, I paid the annual fee so as not to incur additional charges while communicating with American Express that I was on active duty orders. Since XXXX ( a few months after opening the account ), Ive been trying to explain to the card company that Im eligible for MLA relief, even providing them encl. ( XXXX ) and ( XXXX ), to validate that I was on active duty when I applied for the credit card. Nevertheless, American Express keeps rejecting my request, even though they keep thanking me for my service whenever I contact their Customer Service Department. In order to ensure that the error is not in my record, I contacted the Defense Enrollment Eligibility Reporting System ( DEERS ) Support Office ( XXXX ), and they confirmed that I was on orders from XXXX XX/XX/XXXX to XXXX XX/XX/XXXX, as reflected in encl. ( XXXX ). Please let me know if you have any questions or need additional info to resolve this matter.
