Attention : XXXX, EQUIFAX, XXXX Per IRS there are XXXX qualifiers for 1099-C Cancellation of Debt : File Form 1099-C for each debtor for whom you canceled {$600.00} or more of a debt owed to you if : You are an applicable financial entity. An identifiable event has occurred. By definition of the above publication see IRS website link : https : //www.irs.gov/forms-pubs/about-form-1099 c # : ~ : XXXX % XXXX % 201099 % XXXX % XXXX, An % XXXX % XXXX % XXXX % XXXX. I am not obligated for the debt that XXXX XXXX has cancelled as an identifiable event has occurred and the applicable financial entity [ XXXX XXXX ] has filed a 1099C cancellation of debt in which they have already written off. I have explained these matters to XXXX XXXX and they've stated they would investigate the matter and provide a resolution. Meanwhile, I've already provided and obtained proof of the filing of the Cancellation of Debt 1099C by the company ( with proprietary account # 's and identifiers blocked out for my protection and theirs ). This XXXX XXXX XXXX XXXX is now showing on my personal consumer report as delinquent ( which is inaccurate ) It should be shown as a closed account and not as a " charge off '' because the company has cancelled the debt as an identifiable event has occurred per their filing of the 1099C Cancellation of Debt. Also, even though the account is no longer active, the Credit Reporting Agencies are allowing the Lender to update the amount of the debt monthly reporting the amount as {$100.00} higher than the originally cancelled amount which was {$2200.00} and is now {$2700.00}. XXXX EQUIFAX AND XXXX are complicit in the violations committed by XXXX XXXX XXXX XXXX against the Fair Debt Collection Practices Act 807. False or misleading representations 808. Unfair practices and is in Violation of Fair Credit Reporting Act. The lender has made their money back through insurance and is now trying to collect in addition to what they've been able to recoup which goes against TILA ( Truth In Lending Act ), this practice has not been disclosed in the agreement signed with the Card company. The Bureaus job is to operate in favor of what is right by law for the protect of the consumer, in this case as with many cases, this is not what has been the experience and something needs to change.
