My name is XXXX XXXX XXXX and Im formally disputing the following fraudulent account that was just posted to ALL of my consumer credit reports by XXXX XXXX XXXX , XXXX ( XXXX ) on or about XX/XX/XXXX ( See Exhibits A & B ) : Fraudulent Creditor : XXXX XXXX XXXX , XXXX ( XXXX ) Acct. No. : XXXX XXXX Reference No. : XXXX XXXX XXXX XXXX XXXX. XXXX, MN XXXX Fraudulent Debt : XXXX for {$100.00} As good cause, I formally dispute this debt as 1 ) it is NOT MY DEBT ; 2 ) it is an UNLAWFUL attempt to collect a debt under the laws of the Fair Credit Reporting Act ; and 3 ) it is a FRAUDULENT attempt to collect a debt that was previously attempted by XXXX for the EXACT same amount back in XXXX. First, THIS IS NOT MY DEBT!!! I DO NOT OWE ANYTHING TO XXXX!!! Ive been a continuous XXXX customer since as my wireless service provider since XX/XX/XXXX. In fact, I remained a XXXX customer all the way up to their merger and acquisition by XXXX, upon which my XXXX account and SAME PHONE NUMBER was converted over to XXXX. I remain a XXXX XXXX XXXX customer even today and NO POINT IN TIME WAS ANY DEBT OF {$100.00} OWED TO XXXX RAISED TO MY ATTENTION. If it was a valid charge it would have been added to my monthly XXXX bill, which it is not and it has never been. As such, this THIS IS NOT MY DEBT!!! I DO NOT OWE ANYTHING TO XXXX for neither the XXXX Acct. No. : XXXX nor the XXXX Reference No. : XXXX. See Exhibits A -E. Secondly, this is an UNLAWFUL attempt to collect a debt under the laws of the Fair Credit Reporting Act ( FCRA ) by both XXXX and XXXX XXXX XXXX , XXXX. Under the FCRA a Creditor cant report ANY debt or report any account for Collections to any of the Credit Reporting Agencies ( CRA ) until it has made at least a Good Faith Effort to contact the consumer directly and settle the debt BEFORE making any negative reporting to any of the nationally recognized CRAs. However, Exhibit B clearly evidences that the ONLY attempt that was made by either XXXX and XXXX XXXX XXXX , XXXX to communicate directly with me as the purported owner of the {$100.00} debt was via a letter dated XX/XX/XXXX ( See Exhibit B ). But then both XXXX and XXXX XXXX XXXX XXXX XXXX turn right around and report this fraudulently debt to all of the nationwide CRAs, to include but not limited to XXXX, XXXX, XXXX, XXXX, XXXX, and CREDCO / CORELOGIC in less than 24 hours of mailing their collection letter out to me, which violates several clauses of the FCRA laws ( See Exhibit A ). Therefore, this is an UNLAWFUL attempt to collect a debt which again IS NOT MINE!! Thirdly, this is a FRAUDULENT attempt to collect a debt that was previously attempted by XXXX for the EXACT same amount back in XXXX. On or about XX/XX/XXXX, this EXACT same purported debt from XXXX for the EXACT same {$100.00} amount was placed on all of my credit report and was initially fraudulently attempted to be collected by XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, NV XXXX. See Exhibit C. I immediately disputed the accuracy of the exact same account on or about XX/XX/XXXX, across all of the nationwide CRAs and demanded that both XXXX and XXXX XXXX XXXX provide PROOF of the validity of the account, to include the formal paperwork and/or contract with my formal signature and date where I agreed to any consumer products from XXXX to validate all debts. See Exhibit D. Neither XXXX nor XXXX XXXX XXXX could validate the accuracy of the debt to ANY of the CRAs, and therefore the fraudulent debt and collection was already previously deleted from my consumer credit reports for the EXACT same debt from XXXX and for the EXACT same {$100.00} amount back on or about XX/XX/XXXX. See Exhibit E. As such, now both XXXX and XXXX XXXX XXXX , XXXX are knowingly violating several of the FCRA laws by knowingly attempting to collect this exact same debt for a SECOND TIME, which in its self has violated my constitutionally protected Due Process rights pursuant to the 5th and 14th Amendments of the U.S. Constitution , and has violated the equal protection clauses of the 14th Amendment of the U.S. Constitution. 5th and 14th Amendments of the XXXX Constitution. In summary, both the debt and the collection and reporting activities of both XXXX and XXXX XXXX XXXX , XXXX are knowingly FRAUDULENT, UNLAWFULL, and UNCONSTITUTIONAL as a matter of law pursuant to the Fair Credit Reporting Act and 5th and 14th Amendments of the U.S. Constitution, and shall be immediately deleted from my consumer credit report and profile on ALL of the nationwide Credit Reporting Agencies, namely XXXX, XXXX, XXXX, XXXX, XXXX, and CREDCO / CORELOGIC, as a matter of law.
