During the pandemic years, my mortgage was owned/serviced by Community XXXX XXXX XXXX who took over that responsibility from XXXXXXXX XXXX XXXX XXXX XXXX XXXX. Even though the pandemic was at its peak, I approached Community XXXX XXXX in XXXX XXXX about getting on a Loan Modification Agreement. We agreed that, after I made 6 consecutive monthly Trial Plan Payments in the amount of {$3400.00}, which I did, I would then be offered a Loan Modification Agreement, which I was. However, on both XX/XX/XXXX and on XX/XX/XXXX, Community XXXX XXXX sent me the XXXX to sign. Plus, they added new settlement terms without telling me beforehand but did advise me that i should review same with counsel and respond back if I had any questions about the terms of the new XXXX. So, when I wrote back to them on XXXX XXXX XXXX asking which of the two sets of documents should I sign, the XX/XX/XXXX version or the XX/XX/XXXX version, plus asking for an explanation of new XXXX settlement terms, such as a balloon payment after 15 years of which i had no prior knowledge, they decided to ignore me and not answer me. Apparently, this is because they were, at that time, in the process of negotiating the sale of my loan to the infamous lender known as Nationstar Mortgage LLC dba Mr. Cooper who had just been sued in federal court by the CFPB and fined {>= $1,000,000}. It would appear that I have a valid Section 8 claim, under RESPA, for undisclosed settlement costs.
