I received a letter from Silverman Theologou LLP- the week ending XX/XX/XXXX attempting to collect on an alleged debt on behalf of XXXX XXXX XXXX XXXX. I am demanding Silverman Theologou LLP provide the following : 1. ) Provide a certified copy of the original contract, signed by both me and an authorized XXXX XXXX XXXX XXXX employee. An affidavit of loss will not suffice. If they do not have the original contract in their possession, send me information on where the original contract is and when it can be viewed in person. 2. ) XXXX XXXX XXXX XXXX is required by law to get my permission prior to releasing my personal and account information to a third-party. This was done without my consent, which voids the alleged contract. Silverman Theologou has no authority in this transaction and they are in clear violation of 12 CFR 1006.34 ( d ) and 15 USC 1681-S2 ( 7 ) ( A ). 3. ) I want Silverman Theologou to produce the general account ledger statements showing the full accounting of the alleged debt. I am requesting, a signed affidavit by the person responsible for maintaining these records with first-hand knowledge as to the accuracy and authenticity of the general account ledger. 4. ) Deliver proof their law firm is a party to the transaction. They seem to think they have a right to collect when their organization has never signed a contract with me and has never loaned me any money or credit. According to American Jurisprudence 2d 73 ; a third-party collector has no rights if they were not mentioned on the original contract or were any part of the contract; including loans transferred, assigned, sold, or changed hands in one manner or another.
