On or around XX/XX/XXXX I requested and received a three month forbearance on my mortgage. I was transferred long distance for work and had attempted to sell my home. Not a single person requested to tour it, much less buy it. On XX/XX/XXXX I contacted PNC 's Loss Mitigation department to begin the mortgage modification application process. At that time, I was told to wait until closer to the end of my forbearance period. I pointed out that the source of my hardship, a long distance move for work, was not going to resolve if given more time. They still insisted that I wait to apply. I would later find that my instinct was accurate, and I should not have waited to begin the process. On XX/XX/XXXX I began the mortgage modification application process as advised by PNC mortgage. On XX/XX/XXXX, I received a letter confirming from PNC Mortgage that my application was complete. This letter states : " You are entitled to the following foreclosure protection because we have received your complete application. PNC can not make the first notice or filing required to commence or initiate the foreclosure process under applicable law before evaluating your complete application. '' On XX/XX/XXXX, PNC Mortgage requested additional documentation. I immediately submitted that documentation on XX/XX/XXXX. On XX/XX/XXXX, PNC Mortgage commenced the foreclosure process despite the existence of a complete application. On XX/XX/XXXX, PNC Mortgage reported the account delinquent to the credit bureaus, resulting in a 120+ point drop in my credit rating. On XX/XX/XXXX, the credit analyst reviewing my application requests additional documentation, thus rendering y application incomplete. This request for additional documentation from PNC mortgage was not communicated to me at any point by mail, phone, or e-mail. On XX/XX/XXXX, I received an e-mail from PNC Mortgage that mail that had been sent could not be delivered due to an incorrect address. The e-mail from PNC Mortgage requested I call to provide the correct address. I called PNC mortgage at the number provided and the customer service agent belligerently denied that any e-mail had been sent or that any mail had sent or returned. She also forcefully insisted that PNC mortgage had my address correct. On XX/XX/XXXX, I was told by a different customer service agent that PNC Mortgage had attempted to send a " Demand Letter, '' the first step in the foreclosure process, but this letter could not be delivered. This directly contradicts what I was told on XX/XX/XXXX. Additionally, initiating the foreclosure process despite the existence of a complete application is a violation of foreclosure protections afforded to me.
