In the recent Credit File Disclosure provided by Transunion, there are several reporting practices that explicitly violate the consumers federally protected rights. You stated that the consumer has been on your files since XX/XX/2008. Please provide a copy of the application submitted for consumer information to be recorded in your files. Consumer states for the record NO opt out notices were EVER provided, specifically now referring to the opting out of the sharing of nonpublic information with nonaffiliated third parties, pursuant to 12 CFR 1016.10 - Limits on disclosure of nonpublic personal information to nonaffiliated third parties. Furthermore, Transunion is in violation of 15 U.S. Code 1681b - Permissible purposes of consumer reports. On the credit file disclosure, you state consumer has given written authorization for various entities to access the credit file. Please provide a copy of each written authorization that was provided, allowing the proceeding disputed reporting. TOTAL LIST OF THE FOLLOWING : Regular Inquiries, Account Review Inquiries, Inquiry Analysis, Third Party Supplemental Information , Club and Subscription Activity, Collection Accounts. Included is a copy of the Credit File Disclosure provided with violations being highlighted. For the record consumer states they have not given any written, verbal, or non-verbal consent to the following reporting. Consumer is requesting the file be updated immediately. Consumer is requesting compensation for violations. The invoice has been enclosed with this letter. The FCRA, in 15 U.S.C. Sec. 1681n ( a ) ( 1 ) ( A ), allows a consumer to recover any actual damages sustained by the consumer as a result of the [ violation ] or damages of not less than {$100.00} and not more than {$1000.00}. Consumer states for the record they have instructed Transunion to limit prescreened offers of credit and insurance, via XXXX, but now request them to STOP all offers, completely. Please be aware, Consumer has the right to seek damages for injury by suing within a state or federal court. Please place a Security Freeze on the file, immediately.
