After consulting with XXXX XXXX XXXX XXXX XXXX XXXX Legal Aid, on Monday, XXXX XXXX XXXX, I wrote and posted a NOTICE TO CEASE COMMUNICATIONS letter to Midland Credit Mgt , Inc. ( hereafter, MCM ). The first paragraph expressly states, " You are hereby notified to immediately cease all communications with me regarding the collection of a debt. This includes by telephone, mail, email, or any other means of communication to my home. I went on to inform MCM that " The debt is not enforceable because I am a low income senior citizen ; I have no cash reserves or other income to satisfy this debt. My sole income is Social Security which is collection proof ( judgment proof in common parlance ). Social Security is exempt from garnishment [ per Federal law ]. '' I also expressly stated in my letter to MCM that " Any further contact by your firm is a violation of the Fair Debt Collection Practices Act and could result in judgment against you for actual or statutory damages plus attorney fees. '' On Thursday, XXXX XXXX XXXX I received a phone call at XXXX XXXX XXXX, even though I had expressly written the above letter referencing MCM 's account # XXXX regarding collections communications cease. I declined this telephonic communication. I do not intend, nor do I have any desire to be harassed by any member or assigns of MCM , Inc. The Fair Debt Collection Practices Act is quite clear on this point. MCM was put on written notice that I have to desire for any and all communications from them. XXXX XXXX is not on retainer. She merely provided advice.
