Consumer Narrative
I have a billing error and American Express is not crediting my account for my tender of payment I am making. I have 3 accounts with American Express. In XXXX, I endorsed a bill of exchange for each of the these account. An as the holder in due course, I turned the payment coupon I received into a payment instrument as a tender of payment, therefore they are suppose to accept my bill of exchange, if not, the amount tendered is automatically discharge. ( UCC 3-601 - 3-603 ) If my under of payment was not accepted, I was supposed to receive a notice of dishonor but never received that. ( UCC 3-501 - 3-505 ). Instead, I received letters from them stating that have received my payment coupon which has been modified as a payment instrument but they are not going to accept it. It appears that are forcing to make tender of payment for a debt in a a specific form and according to the US Constitution no one can debt a payment of debt in any form but gold and silver and I am fully aware that gold and silver can not be accepted as payment for debt because we are still in a state of emergency since the 1930s. In addition, I am also where that US Government is backed by the credit of the nation, we the people, so I also asked then who funded this account me or did bank did and I never received a response by way of a notice. I am believe fraud is being commit and that I am being swindled and force into paying with gifts via Federal Reserve Notes to American Express every month for my open ended credit account even though I already provided my credit application and the collateral ( Federal Reserve Act Section 16 ) which is sufficient setoff these accounts every month. I also requested over the phone that I receive the Federal Reserve Form 2046 and Federal Reserve Form 2644 know that all banks are requires to fill out these forms for each account with the IRS and they don't want to cooperate. They have been stealing securities and when I try to resolve the issue with them they don't want to cooperate. I also gave them a credit application for in XX/XX/2023 for a platinum card and they denied me. I never got anything in return of equal value of credit application. They claim that I could not be accept at that time because I did not have enough " income '' as if I never gave them anything of value when I gave them the application. [ CFPB 1026.2 ] I can not be denied my own credit [ Equal Credit Opportunity Act and Truth in Lending Act, Fair Debt Credit Practice Act and many other acts has been violated. I have the right to be secured in my person and my consumer rights are being violated in many ways.
