To whom it may concern within the CFPB, I am invoking your authority, and enforcing my right to privacy as granted through acts of Congress. I have a legitimate and lawful right to privacy and I would like to express a very real concern that Experian is actively violating my federally protected consumer rights. Throughout the years I have ordered consumer reports, and I have been a party to declined credit and adverse action as a direct result of the non-public private information revealed and disclosed through Experians consumer reporting practices. The Privacy Act of 1974 - 5 US Code 552a affords me, as a protected consumer the right of consent in all disclosures. The Conditions of Disclosures section of the above act clearly describes No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, and goes on to further outline legitimate and governmental reasons. Your agency is not considered an agency of government, moreover, it could be more closely classified as a non-affiliate, for-profit, third party. This is a clear and direct infringement of my consumer protections, and further outlined in 15 USC 6802, in part saying that a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, without ( A ) Consent, ( B ) The opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) or the ability to exercise nondisclosure via opting out. I was not afforded the opportunity to Opt-out, or allowed to direct how unwanted personal private information was disclosed. I continue to identify instances of Accounts & personal information being shared without my consent written or otherwise per 15 USC 1681b. I am invoking my lawful and federally protected rights to opt-out and direct the manner in which disclosures and dissemination of my private information are made available by Experian according to the rules of the FCRA and 16 CFR 313.10. Experian fits the legal definition of a nonaffiliated 3rd party The term nonaffiliated third party means any entity that is not an affiliate of, or related by common ownership or affiliated by corporate control with, the financial institution, but does not include a joint employee of such institution. However, per 15 USC 1681 sec 602 you are still bound to exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. To be as plain as possible, there are glaring unaddressed violations with the disclosure and dissemination of my information without my proven or documented consent. I am revoking any and all authorization I the consumer may have given you, written, non-written, verbal, and non-verbal per 5 U.S. Code 552a. This puts forth the question What documentation was used and from what source did Experian accept and investigate to verify this furnishing was accurate? 15 USC 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 4. ) Address XXXX XXXX XXXX XXXX XXXX ( Only ) all other addresses are non-mailable & not to be disclosed.
