I, XXXX XXXX, am writing this complaint as a result of being threatened by a debt collector. The name of this abusive debt collection agency is LVNV FUNDING LLC DBA RESURGENT. I, XXXX XXXX, have been constantly harassed and threatened by LVNV FUNDING LLC DBA RESURGENT multiple times. This is both confusing and a violation of the FDCPA per 15 USC 1692e ( 14 ) being that they have two names. LVNV FUNDING LLC was sent a request to properly validate the alleged date on XX/XX/year>. Within the letter requesting validation of debt, LVNV FUNDING LLC was also told to " cease and desist '' as quoted directly from the letter sent to them, " If your offices are able to provide the proper documentation as requested pursuant 12 CFR 1006.34c in the following Declaration, I will require at least 30 calendar days to investigate this information, during which time all collection activity shall CEASE and DESIST. '' This request was not honored and LVNV FUNDING LLC persisted to harass me XXXX XXXX immediately after receiving a notice to properly validate the alleged debt which is a violation per 15 USC 1692c ( c ). LVNV FUNDING LLC were asked questions in the request for debt validation as an attempt to confirm if they were legally allowed to have XXXX XXXX 'S personal information and if they were legally allowed to collect in the state I, XXXX XXXX resided in. They completely ignored those questions and persisted on sending more electronic emails coercing XXXX XXXX to pay the alleged debt by bringing attention to the fact that they are counting down before they take legal action by sending the matter to an attorney which is a violation per 18 U.S. Code 894 - Collection of extensions of credit by extortionate means and per 15 USC 1692e ( 4 ), and 15 USC 1692e ( 10 ). LVNV FUNDING LLC did all of this without proving that the alleged debt legally belongs to XXXX XXXX. This behavior is harassment, and abusive, and quite frankly causing unnecessary stress and emotional discomfort which is a violation of the FDCPA. LVNV FUNDING LLC is also furnished the collection account inaccurately on XXXX XXXX 'S consumer disclosure reports in which the information in the payment history section is reflected as " No Data '' which indicates an incomplete account. This is a violation of the FCRA per 15 USC 1681 pertaining to accuracy and fairness of credit reporting. I, XXXX XXXXXXXX, am aware that LVNV FUNDING LLC were sued by KEVIN LARGE v. LVNV FUNDING LLC, PENNELL v. LVNV FUNDING LLC, and RAMOS v. LVNV FUNDING LLC. Each case the lost for abusive behavior. LVNV FUNDING LLC is liable per 15 USC 1692K Civil liability and many more violations. Lastly, LVNV FUNDING LLC was sent an Affidavit of Truth in which they ignored and did not rebuttal.
