The situation is in regards to Westlake Portfolio Management and U.S. Auto sales. U.S. Auto sales is the original credit lender to my vehicle ( XXXX XXXX XXXX, VIN # XXXX ). On XX/XX/XXXX U.S. Auto sales closed their doors without any notice or warning. My loan was then transferred to Westlake Portfolio Management shortly after. Not too long after that did we learn that U.S. Auto Sales had filed for bankruptcy and was being sued due to the fraudulent activity of never paying for the warranty provided by XXXX XXXX XXXX XXXX ( DOWC ). Once everything was further reviewed we were made aware that the warranty and Gap that were agreed upon in my contract were null and void. When I made efforts to contact Westlake to see if my warranty was being honored or refunded they told me that they do not know and to contact their new warranty company. When I did so the warranty company named XXXX replied to me via Email that I do not have a contract with them. The new company who is claiming to be my original creditors have not provided me with a new contract connecting me to a loan provided by them. My lawyer has written to Westlake twice now demanding a contract rescission under the primary XXXX XXXX XXXXXXXX XXXX XXXX. Of which is only one of the many laws violated within the contract provided by U.S. Auto Sales and now by Westlake Portfolio Management. Also in attempts to communicate with Westlake all representatives are very rude and controversial. It appears as none have been taught about the situation and have been given scripts that do not aid in the transition to Westlake. Westlake has failed to make any proper communications regarding the letter that has been sent to them Twice and can not supply a single answer to my questions without them being met with controversy. My husband XXXX XXXX and I are both on the account for this vehicle. Both of our credit scores have been attacked. XXXX XXXX is an active duty service member and received DA orders for Recruitment and we will be moving, but can not buy or even rent with this attacking our credit scores.
