Consumer Narrative

XXXX, Equifax, and XXXX, as reporting agencies, did not receive consent from me, as the individual to whom the record pertains, to disclose any record of my information. Per the privacy act of 1974 No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains. An inquiry comes up on a credit report when there is a request to see your credit report from a company or person. This means that in order for a reporting agency to follow the privacy act of 1974 before disclosing my information to a person or company they should contact me and get authorization to do such actions. This was not done, but there are hard inquiries showing on my credit report none of which are linked to open accounts. Not only are they a violation of the privacy act of 1974 because my information was given to these companies without prior consent, but Unless you, as the reporting agency, can provide me with documentation proving these inquiries are linked to an open account on my credit report they need to be removed per 15 USC 1681b.
