I applied for public service loan waiver when that went into effect and sent all of my paperwork in to fedloan who was in charge of pslf program. I was pleased to find out I qualified for the forgiveness and had made 159 qualifying pslf payments. My 120 payments ( 10 years worth ) according to fedloan would have been done on XX/XX/XXXX ( I have the letter from fedloan ). According to the XXXX waiver, any payments made after 120 would be refunded to me as an overpayment due to waiver. Well I waited to get my refund check from the department of treasury and never recieved anything. I waited the recommended time frame of 4-6 weeks and emailed fedloan and asked when to expect my refund. Fedloan emailed back and said they didn't have my payment records on my loans after XX/XX/XXXX so they had nothing to send to department of treasury for refund. This was not true, because when I had access to my XXXX account online I could see all of my payments that qualified for XXXX and it was 159. They told me that since my loans were discharged through the pslf they no longer had my records and would have to open a reconsideration case with department of education FSA. Which I did file a case complaint/reconsideration and got a letter that makes no sense. They said that because my loans were paid off in XX/XX/XXXX, and I didn't make payments after that I would not get a refund. They didn't even look at my emails I sent them saying I qualify for pslf as of XX/XX/XXXX and will be due to get refund after the 120 payments. I am getting the run around and no one has my records it seems of my pslf and how many payments I have made. This is frustrating. I need help as fedloan is not even in business anymore. I reached to nelnet who is supposed to be holding my records but when I called they said they could not help me because they were not my loan servicer, but my loan servicer who handled my pslf is no longer in business. I am not sure how to handle this. I have been on reddit and people who were in the exact same position ( no refund, even though we clearly qualified for it ) had said to file a complaint here for help and they had some success.
