I am writing to file a complaint against Patenaude and Felix, A.P.C. ( debt collector ) and XXXX XXXX XXXX XXXX XXXX XXXX ( debt collectors client ) for violations of state and federal consumer financial laws. Patenaude and Felix, A.P.C. and XXXX XXXX XXXX XXXX XXXX XXXX have acted deceptively, unfairly, abusively, and in bad faith by opportunistically exploiting the pandemic to breach debt settlement agreements and file fraudulent judgments in an attempt to alter settlement terms for financial gain. The details are as follows : - On XX/XX/XXXX, a debt settlement agreement was executed between myself and XXXX XXXX XXXX XXXX XXXX XXXX, represented by Patenaude and Felix, A.P.C. ( hereinafter " Patenaude '' ). - In accordance with Patenaude 's instructions, an automated payment method was established, providing the necessary account information for monthly payments. - Patenaude confirmed receipt of the account information and approved the automated payment method. - Payments were consistently made on time per the settlement agreement until the onset of the pandemic. - During the pandemic, Patenaude ceased processing payments, attributing their failure to do so to pandemic-related issues ( admitted by Patenaude in writing, available upon request ). - Despite my multiple attempts to reestablish payments, Patenaude has repeatedly refused to accept payments per the terms of the settlement agreement, explicitly stating that they and XXXX XXXX XXXX XXXX XXXX XXXX were unwilling to abide by the agreement ( written documentation available ). - Instead, Patenaude and XXXX XXXX XXXX XXXX XXXX XXXX is seeking to change the settlement terms to secure an exorbitantly higher settlement amount ( documented in writing ). - On XX/XX/XXXX, Patenaude fraudulently filed a judgment against me, alleging a breach of the settlement agreement. - The current amount proposed by Patenaude is double the amount that was agreed to in the original settlement agreement. I respectfully request an investigation into these matters and appropriate action be taken. I am willing to provide any necessary documentation to support this complaint.
