Ive reached out to the Bureaus before regarding the XXXX Account XXXX and disputed it on the basis that I NEVER gave XXXX permission to access my credit report nor apply for a personal credit card with them. This was a business account. In my previous disputes both Equifax and XXXX gave me the run around. I then decided to reach out directly to XXXX and see why they decided to put this account on my credit profile and try and hold me liable for an account that was not authorized nor opened by me. Discovers response to me was they verified this account through public record and say that they held me liable because I made calls into them to make payments. There are factual errors to their claims, and they go directly against the FCRA. This account was opened on XXXX XXXX XXXX under the business : XXXX XXXX XXXX XXXX XXXX XXXX Being that this is a business account my personal information was NEVER given. The EIN was provided for the business and that was it. I AM NOT a personal guarantor on this account. It was solely a business account. The address associated with this account was XXXX XXXX XXXX, XXXX, GA XXXX and phone number XXXX. XXXX refers to this account as an individual account instead of a personal account is because they know this was never a personal account. As a consumer I have the right to a credit report that is 100 % accurate. XXXX says they verified this account through public records where they claim that I lived in XXXX XXXX XXXX XXXX Ga from XXXX until now. This Error is debunked directly on my Credit profile with both Equifax, and XXXX where my address have changed several times since XXXX which are listed on both profiles : XX/XX/XXXX : XXXX XXXX XXXX, XXXX, GA, XXXX, XXXX XXXX XXXX, XXXX XXXX, GA, XXXX, XXXX : XXXX XXXX XXXX XXXX, Ga XXXX, and currently XXXX XXXX XXXX XXXX XXXX, GA, XXXX. This shows that XXXX not only illegally accessed my credit profile but also are reporting information that is FALSE. I was not living on XXXX XXXX XXXX XXXX which is 6 years after this account was opened so the public record that XXXX says they want to hold me liable for this account is also FALSE. In addition, in the FCRA 607 - 15 U.S.C. Certain public record information. Except as otherwise provided in section 613 [ 1681k ], a consumer reporting agency shall not furnish an investigative consumer report that includes information that is a matter of public record and that relates to an arrest, indictment, conviction, civil judicial action, tax lien, or outstanding judgment, unless the agency has verified the accuracy of the information during the 30-day period ending on the date on which the report is furnished. This also shows that XXXX has no right to publish any public records on my credit report because : I HAVE NEVER GIVEN XXXX PERMISSION TO ACESS MY PERSONALINFORMATION, nor have I ever worked at XXXX. Therefore, they have no grounds to publish this inaccurate, unverified, false information to my report. XXXX says that I made payments on the account from XXXX and maintained making payments which means I am liable. I can use my phone to make a payment on whatever account I choose however, I have NEVER agreed to be a personal guarantor of this account. I havent given verbal, physical, nor electronic signature nor authorization approving moving this from a business account to a personal account. Again, this account was opened in XXXX which shows for 7 years this account was the responsibility of another entity, XXXX has no documentation nor authorization of this account being changed in responsibility roles. However ONLY want to hold me liable for the period of XXXX this is illegal. The reason there is a 7-year gap in Discovers explanation because this again is not a personal account. This is a business account. XXXX never had the authorization to use my personal information, Ive never given XXXX my XXXX. Therefore, XXXX is defrauding, and both Bureaus are allowing it. XXXX has not only violated the FCRA numerous times, but they have also violated my rights as a consumer. I have the right to a credit report that is 100 % accurate. XXXX, XXXX, and Equifax are violating my rights and I would like the CFPB to step in and assist with this matter. Attached to this complaint I have included Discovers response to me that shows that they are using public records that are unverified, shows where they say I have lived on XXXX XXXX XXXX XXXX until now which is untrue, shows them saying because I made payments and verified activity on the business account that I am liable which is untrue I have never been a personal guarantor on this account I can manage an account and not have personal liability to it unless it was agreed upon, and everything else that is listed above. I am asking that Equifax and XXXX remove this fraudulent account off my credit profile immediately.
