On XX/XX/XXXX, I signed a Loan Modification Agreement and Partial Claim Deed of Trust with Dovenmuehle Mortgage. ( see attached documents ) Dovenmuehle never processed the loan modification in their system. I have been calling loss mitigation for over two years and they would say they are behind in processing. I have been making payments since XX/XX/XXXX. During covid I did miss some payment due to unemployment but, payments have been made. Dovenmuehle Mortgage said I did not make any payments XX/XX/XXXX to XXXX XXXX also XX/XX/XXXX to XX/XX/XXXX, so therefore they are not going to process the Loan Modification Agreement and Partial Claim Deed of Trust. ( Attached are statements from Dovenmuehle Morgage showing transaction where payment was paid during those time period ). Dovenmuehle never XXXX the loan out to start in compliance with the Loan Modification Agreement. ( Attached are statements dating from XX/XX/XXXX to XX/XX/XXXX ) showing the pass due amount continue to get larger and larger. They now say that I owe {$57000.00}. All payments made were going to unapplied. I had over {$51000.00} in unapplied funds as of XX/XX/XXXX. Dovenmuehle applied {$910000.00} to fees. This is unfair and deceptive trade practices. How can they not book the loan modification per the agreement that has been signed and recorded at the county clerk office? I do not owe Dovenmuehle mortgage {$57000.00}. Dovenmuehle is trying to cover their self 's because they never processed the Loan modification agreement in their loan system in XX/XX/XXXX and now, they want us to pay for their mistake. They are probably doing the same thing to other customers.
