XXXX XXXX XXXX XXXXXXXX XXXX XXXX Property Address XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX In XXXX of XXXX I received mortgage statements for XX/XX/XXXX payment due dates from XXXX XXXXXXXX XXXX ; the lender I had come to know as my mortgage holder for three separate loans on three separate properties I own. As my mortgages are not considered late if payment is received before the XXXX of the month ; I mailed my mortgage payments out on XX/XX/XXXX. The checks were date stamped by XXXX XXXX on XX/XX/XXXX and subsequently cashed on XX/XX/XXXX. On Friday XX/XX/XXXX Roundpoint prepared a Notice of Change of Loan Servicer. I received the notice from XXXX sometime around the following Thursday XX/XX/XXXX. The Notice indicated XXXX would be my new loan servicer as of XX/XX/XXXX. I received the Notice from XXXX long after the loan due date and long after the payment had been mailed and received by the historic loan servicer. XXXX failed to properly notify me they had purchased my mortgage loan in XXXX of XXXX. As evidenced by their own correspondence dated XX/XX/XXXX they are in violation of proper notification laws. A company can not notify you XX/XX/XXXX for a XX/XX/XXXX payment due date and then charge you late fees when they do not receive the payment : This is a prime example of a violation of mortgage transfer notification laws. Attached are my canceled checks from XXXX XXXX, my previous lender. XXXX XXXX clearly date stamped the checks XX/XX/XXXX. Attached also are copies of the mortgage statements I received from XXXX XXXX stating my payment was due to them on XX/XX/XXXX. XXXX is in violation of mortgage collection laws by charging me late fees when my mortgage was paid on time. XXXX is in violation of mortgage loan collection laws by holding my good credit hostage, and attempting to strong-arm me into paying late fees, when I paid my mortgage payments on time. XXXX is defrauding me by refusing to give me interest credit for principal I paid over 4 months ago. XXXX has been holding {$7200.00} of my money for over 4 months now and refusing to return it or apply it to my mortgages. XXXX needs to properly apply my mortgage payments and back date the principal reduction payments and credit me the extra interest they have been charging me on the scheduled and additional principal I have been paying for nearly a half a year. XXXX XXXX is in violation of mortgage collection laws regarding threatening and abusive phone calls. They have called me multiple times only they can not tell me which property they are calling about. How am I to know which property they are calling about when they have defrauded me on several different properties? They call and ask me argumentative things like what is your phone number. They just called me, certainly they know what phone number they just called. How am I supposed to know if this person is a professional scammer or not. They ask me to verify my social security number ; I never give my social security number to some stranger, calling me on the phone. Then they get upset and hang up on me. These are all examples of violations of mortgage collection phone contact laws. XXXX XXXX has violated several mortgage lending laws, has defrauded me on multiple occasions and continues to do so. They have ruined my credit preventing me, a real estate investor by trade, from obtaining mortgage financing for my current projects. For the first time in over 40 years I have been denied credit because of XXXX mis-reporting. XXXX needs to be held accountable for their malicious, illegal and fraudulent behavior. If XXXX has done this to me a mortgage professional, ( my mortgage company has been in the same place for 32 years ) how many other people have they done this to? I believe an audit of XXXX 's business practices will reveal rampant fraud within their origination.
