The complaint relates to the purchase of open water scuba pool sessions at XXXX XXXX XXXX via XXXX on XX/XX/2023 for {$230.00} using my Capital One quicksilver card. XXXX XXXX XXXX : XX/XX/XXXX Description of the XXXX deal - Scuba Diving Certification for One This is the beginner entry into scuba diving. This open water class is a combination of e-learning and traditional classroom. Once completed you will have earned an open water certification that is nationally and internationally recognized. XXXX XXXX XXXX promptly requested my voucher number in order to give me access to the e-learning course and subsequently marked it as redeemed on XX/XX/2023 without scheduling the classroom training and certification classes that was part of the deal. See email attached. I made various efforts to contact XXXX XXXX XXXX via telephone, email, and XXXX XXXX, as evidenced by the enclosed screenshot of our interactions. Despite my earnest attempts, I received no response regarding the scheduling of the classes. I was hoping to receive my training within 30-45 days of purchasing the XXXX as I had a long vacation planned out of the country at the end of XXXX. At no point did the XXXX fine prints mention that I will have to wait for an indefinite period of time before I can expect the full and complete delivery of the services described. Regrettably, my attempts to secure a response from XXXX XXXX XXXX proved unfruitful via phone or online messages. I reached out to XXXX customer service who refused to return my money as once the voucher is marked redeemed they can not or will not assist any further unless I obtain written confirmation from the XXXX school confirming that the service was not provided. Needless to say, getting a response from the XXXX XXXX XXXX is impossible as they don'y reply to calls, texts or emails. So, I filled a dispute with Capital one as a last resort as I was still within the 90 day period and provided capital one dispute team with proof indicating that the service was not delivered as promised. However the Capital one dispute team decided to side with the merchant as the merchant had marked the XXXX as redeemed. My husband had purchased the sameXX/XX/XXXX with his XXXX card and he had the same problem. However, XXXX promptly refunded him the money and didn't wrongfully side with the merchant. I am requesting a full refund for the disputed charge, given that the services were not rendered as described under the groupon deal description, and the merchant failed to respond to my inquiries over an extended period and for the time, energy and stress this whole situation has caused me.
