Ive been trying for months to remove this account off of my report. This account was not authorized by me. i have recently been informed of being a victim of identity theft. i have also been notified that by reporting these accounts, the companies are in violation of the fait credit reporting act. Equifax, XXXX and XXXX are governed by the FCRA, an according to 15 USC 1681 b ( a ) ( 2 ) clearly states Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 1 ) In response to the order of a court having jurisdiction to issue such an order, a subpoena issued in connection with proceedings before a Federal grand jury, or a subpoena issued in accordance with section 5318 of title 31 or section 3486 of title 18. ( 2 ) In accordance with the written instructions of the consumer to whom it relates. It isnt possible for me to give written consent on a account that wasnt open by me. They are also violating the Gramm Leach Bliley Act. Which states that a consumer must be given the right to opt out of their information being reported. No lender ever gives that option. With that being said i demand that the following accounts be removed from my credit report.
