This was my wife, XXXX 's loan of {$18000.00} from Best Egg. I wrote on her behalf and notified them We are experiencing extreme financial hardship as a result of severe health problems including an XXXX XXXX I suffered and multiple XXXX XXXX my wife suffered that has caused massive medical bills and left us both XXXX, physically and financially. I am XXXX, XXXX is XXXX. You proposed a settlement option '' of our financial hardship. Your agent, XXXX XXXX # XXXX ), who had written us offering XXXX interest options, called XXXX who gave me permission to talk with him since I am not a party to the loan. He said he was authorized to cancel the old loan and propose a loan under new terms. We would not agree without written loan papers which he promised to send via email immediately after our call. He stated the terms, I repeated them, I gave him my autopay info, he said I was correct, then said, " plus the {$440.00} ''. then hung up and did not follow through with his promise to mail the papers. The call was recorded. XXXX then signed a new loan on their website in our names after removing and cancelling the old one. He used my debit check card number WITHOUT my permission. I cancelled this immediately via email and phone the next morning, explained the fraud to his office and they cancelled the transaction. We no longer trust anything said to us as this obvious fraud clearly raised questions as to their business integrity and/or willingness to follow existing law. Their agent CANCELLED the original loan and replaced it on his own with a fraudulent one signing XXXX up and using my autopay information wholly without our permission. Since they unilaterally cancelled the original loan, it is null and void. I responded to their letter dated XX/XX/2023 in which they are attempting to collect a debt. Please record that our only income comes from Social Security and workers compensation benefits that are protected by Federal law from garnishment to pay a debt owed to a private person or company. My total income is XXXX XXXX monthly, my wifes is XXXX XXXX monthly. The only other income is an annuity she received as compensation for being 100 % XXXX from her employment, an amount less than her SS. Our mortgage is {$2100.00}. Thankfully, our equity is protected by our automatic homestead in AZ which will keep us in our home which we have owned for 10 years.
