Complaint against Hyundai Capital America, Account # XXXX To Whom It May Concern : This letter is to dispute the inaccurate and negative information Hyundai Capital America ( XXXX ) furnished to the three ( 3 ) Credit Reporting Agencies ( CRA ). Hyundai Motor Finance violated my Fair Credit Reporting Act ( FCRA ) rights which are listed below. 1. FCRA 623 ( a ) ( 5 ), 15 U.S.C. 1681s-2 ( a ) ( 5 ) 2. FCRA 623 ( a ) ( 8 ) ( E ) and 623 ( b ) ( 1 ) ( E ), 15 U.S.C. 1681s-2 ( a ) ( 8 ) ( E ) and ( b ) ( 1 ) ( E ) 3. FCRA 623 ( a ) ( 6 ), 15 U.S.C. 1681s-2 ( a ) ( 6 ) 4. FCRA 623 ( a ) ( 2 ), 15 U.S.C. 1681s-2 ( a ) ( 2 ) HCA is reporting my account as being charged off instead of account closed. Traditionally charge-offs occur when a customer is at least XXXX days late paying their bill. As you can see from the payment history provided, I have never been 120 days past due. Lastly, there is no indication that XXXX sold this account to a debt buyer or transferred the account to a collection agency. If so, I would have been made aware by the collection agency that my account was delinquent and given an opportunity to resolve the matter. This did not happen. XXXX is reporting that the 1st day of delinquency is XXXX. This is inaccurate! Based on my payment history, all payments were made consistently each month. Enclosed are bank records and Hyundais monthly statement showing that I made a payment in XXXX and XXXX. On XX/XX/2023, I sent a dispute letter to all three ( XXXX ) credit bureaus informing them of the inaccurate information that was placed on my credit report. XXXX updated my credit report, which still reflects a charge-off and a false delinquency date. It is my hope that after your investigation : XXXX. My XXXX account will reflect a closed account instead of a charge-off, and XXXX. The delinquency date be removed, and all payments updated to reflect paid on time. XXXX has a grave responsibility to report true and accurate information on a consumers credit report. The inaccurate reporting charge-off has lowered my credit score and decreased my credit score and buying power. I am in arbitration with XXXX because they have violated other laws as well.
