I submitted a dispute request to the credit reporting agencies, I asked for an investigation into an account that is reporting an inaccuracy on my consumer report. The XXXX XXXX account is being reported as a charge off, according to IRS Publication 4681 Canceled Debts, Foreclosures, Repossessions, and Abandonments : the lender must file Form 1099-C and send you a copy if the amount of debt canceled is {$600.00} or more and the lender is a financial institution, credit union , federal government agency, or other applicable entity as discussed earlier in chapter 1. Once again according to the IRS publication 4681, even if you didn't receive a Form 1099-C, you must report canceled debt as gross income on your tax return. The IRS clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes the reporting of this account inaccurate! I also asked for the following information : 1. A detailed description of the method or process used to verify the accuracy of the disputed charged-off amount on my credit report. 2. The specific documents or evidence obtained and reviewed during the verification process, including any correspondence or communication with the creditor involved. 3. The date on which the verification process was conducted and completed. 4. The name and contact information of the individual or entity responsible for conducting the verification process. 5. Any other relevant information that sheds light on how the accuracy of the disputed charged-off amount was established. To this day I still have not received the information requested. The balance that was being reported as written off is not the same amount that is on the 1099C form, which is also another inaccuracy. Overall, this company has violated many FCRA laws including : *15 U.S. Code 1681e ( b ) Accuracy of report *15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies and ( B ) Reporting information after notice and confirmation of errors
