Consumer Narrative

On or about XXXX, XXXX, I sold my home at XXXX XXXX XXXX XXXX XXXX TX XXXX. At the time of the sale, I had XXXX home monitoring service and 'smart home ' equipment. The buyer, XXXX XXXX, called XXXX to transfer my contract to them, and rather than transfer my contract as I had instructed XXXX and XXXX XXXX to do, XXXX created a new account for her using my equipment and did not inform me. After a period of approximately 6 months, I received a collections call from XXXX telling me I owed approximately {$650.00}. I disputed this and refused to pay given that there was call evidence that XXXX XXXX properly instructed XXXX to transfer the contract and not start a new one. Unbeknownst to XXXX XXXX, the new contract was created. During my dispute and refusal to pay XXXX during this period, I filed a consumer protection complaint with the Texas Atty. General 's Office, complaint ID XXXX. In addition, I informed XXXX over the phone that should they continue, I would file a claim in small claims court and ask for compensatory damages. Following this, XXXX ceased trying to collect on this debt at approximately XX/XX/XXXX. Starting approximately XX/XX/XXXX, Zion Debt Holdings LLC informed me that they had purchased this outstanding debt and were now attempting to collect. I explained the situation to them and started a dispute. They maintained that it was their right to collect. I explained to them that should they continue this course of action I would pursue legal remedy. Nothing more came from this. On Thursday, XX/XX/XXXX I received a notification from my XXXX XXXX credit monitoring app that my score had dropped significantly. Upon investigation, this {$660.00} debt was marked as charged off by Zion Debt Holdings. ZDH has no right to mark this as a chargeoff as this was an improper debt to collect in the first place. XXXX wrote off this debt and ceased attempts to collect once it was determined that evidence was not in their favor and that they were, in fact, in the wrong. Zion purchased this debt from XXXX inappropriately and attempted to collect even after informed of this situation, then proceeded to file against my credit which I have maintained a literal perfect payment history. I have NEVER missed a payment for any debt. Zion 's actions are malicious and intentional as I told them to pound sand and that I would pursue legal action should they not cease their attempts. I will be exploring legal action against ZDH.
