DO NOT MARK AS A DUPLICATE, THIS IS INTENDED FOR EQUIFAX. My name is XXXX XXXX, and I am writing to delete the following inaccurate and incomplete information in my file. The items I need deleted are listed in the report. I am a victim of identity theft and did not make the charge. I ask that the items be deleted to correct my credit report. I reported the theft of my identity to the Federal Trade Commission and I also have enclosed copies of the Federal Trade Commissions Identity Theft Affidavit. Please delete the items as soon as possible. I have been a victim of identity theft and many accounts were established in my name without my knowledge or consent. The following information you have placed on my file has seriously affected my ability to obtain credit. Please be reminded that it is important for credit agencies to maintain accurate information per The Fair Credit Reporting Act. I have provided you with a Federal Trade Commission Identity Theft Report detailing the incident. I have hired a private investigator and an attorney to help stop the use of my name by someone who has stolen my identity. The inaccurate items do not belong to me and should be deleted from my credit file immediately. Based on, 15 U.S. Code 1681c2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items as soon as possible! These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. 18 US Code 1028A states that whoever knowingly transfers, possesses, or uses my information, without lawful authority, a means of identification of another person shall, in addition to the punishment provided for such felony, are sentenced to a term of imprisonment of 2 years. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. As a consumer I am demanding the deletion of the accounts listed IMMEDIATELY. I AM REQUESTING THE ORIGINAL COPY OF THE AGREEMENT AND TERM & CONDITIONS. PLEASE DO NOT VERIFY THESE ACCOUNTS WITHOUT PROVIDING ME ORIGINAL AGREEMENT, MY WRITTEN INSTRUCTIONS TO FURNISH ONTO MY CREDIT REPORT, AND MY SIGNATURE ON THE AGREEMENT.
