I recieved a notice today on my door from The Guild Mortgage Company that my Loan and mortgage is in defualt due to the beneficiary authorized agent has excersized due diligence to contact teh borrower and the borrower did not respond '' This is absolutely not true. I as the third party on the mortgage of my property that i was awarded in my divorce and added as a third party on the loan years ago, i have contacted Guild Mortgage several times, and due to an error on their part, someohow they have removed my name off of the loan and refused to talk to me. My attorney i had used at the time of my divorce that had handled my name being added as a third party onto the loan, has written and sent a letter 8 times to Guild Mortgage regarding this error and they have not responded. after my name was added as a third party onto the loan with The Guild Mortgage Company, I applied for and was granted the Forebearance program for a year, in my name, when the year was up, i recieved a letter that i owed the {$36000.00} and i contacted the company immediatly, and they refuse to speak to me because they said now, my name is not on the loan. Obviously it was when i was awarded the forebearance program. My loan being in default and my property being up for auction is due to Guild Mortgage refusing to communicate or work with me at all because of their mistake. Furthermore, the documentation that The Guild Mortgage Company recieved when my namme was added to the loan, i assume has kept a copy of or records for their own protection and account history, and when the forebearance program ended and the loan came up to make arrangements to start payment on, I find it difficult to believe that the company did not look into the account and see that i was added as a third party onto the loan and had been awarded the forebearance program under my name. The error needs to be corrected, the reason my loan is in default is Guild Morgtgages fault, due to their refusal to speak with me or deal with me at all, and the notice i recieved with the attatched copy of the declaration ursuant to rcw 61.24.031 ( 2 ) in which the box # 4 is marked that states " the beneficiary or beneficiary 's authorized agent has excersized due diligence to contact the borrower as required and the borrower did not respond '' is a lie. they have refused to speak to me, and further more, my attorney that assisted me with getting me added to the loan as a third party has sent the same letter 8 times to guild mortgage I myself have called more times than i can recall to count. My account needs to be brought out of default immediatly, my name needs to be added back onto the loan as a third party, like it was before, and was on there during the application for the forebearance program for the covid 19 pandemic, and when i was approved for the program until it ended and now suddenly my name is no longer on it and Guild has refused to speak to me, or the attorney that has sent them numerous notice of error letters, and furthermore refused to even look into the loan account history and validate that my name had been added on as a 3rd party after my dvorce when the property was granted to me. Her name has been removed from the deed of the property as per the judgement and the judges signiture in leu of a signed quick deed. furthermore I need reimbursed for the stress and time and money i have spent trying to resolve the issue with Guild Mortgage, The treatment from Guild Mortgage has caused me such an enormous amount of stress that is affecting me physically and causing me health problems. I need to be given the options given to every other borrower that was awarded the forbearance program from the covid 19 pandemic, and be able to either set up future payments on my loan with The Guild Mortgage Company, or the ability to possibly sell my property and pay off the loan, or part of my property to pay off the loan, which i will be unable to do due to the default status it is now in, and due to Guild Mortgage refusing to speak to me or allow me to make arrangements or find out what my options are now that the pandemic forebareance program year ended, that now because of that i am at serious risk of loosing my property that i have paid the majority of it off, and it appears that this error on their part is more than convenient and i would not be surprised if this " error '' ends up being a practice that Guild impleminted to several other consumers with the same history of divorce and name changing on the loan, and possibly becomes a class action law suit.
