I have had a mortgage loan with Wells Fargo since XX/XX/XXXX without any missed payments. My XXXX is currently at 56 %. I reached out to Wells Fargo regarding eliminating my Escrow Account. Well Fargo has refused citing a mandatory requirement that they can not by law remove an escrow account. They further stated that I must maintain an Escrow Account with Wells Fargo for the life of the loan according to the XXXX. I understand that the XXXX can require an escrow account to stay open, but Wells Fargo is not saying that they want the escrow account to remain open. Wells Fargo is stating that they are REQUIRED that I maintain an Escrow account because it is a XXXX XXXX, and the XXXX says that I have to have one. I have a saved chat transcript, and a word dictation of the conversations with Well Fargo representatives saying that they I am REQUIRED for the life of the loan to maintain an Escrow Account with them. Her is what The VA specifically says on the subject of XXXX XXXXXXXX : Lenders Handbook - XXXX XXXXXXXX XXXX Chapter 9 Legal Instruments, Liens, Escrows, and Related Issues Specifically Page 25 states the following 12. Escrow for Taxes and Insurance 9-25 Change Date XX/XX/XXXX This chapter has been revised in its entirety. a. Requirements XXXX does not require the lender to establish escrow accounts for the collection and payment of property taxes, hazard insurance premiums, and similar items. It is the lenders responsibility to ensure that property taxes and hazard insurance premiums are paid timely. A lender who chooses to escrow for taxes and insurance must comply with applicable laws, including the Real Estate Settlement Procedures Act ( RESPA ). The reason why I want to cancel the Escrow account is that Wells Fargo has committed fraudulent activities on this Escrow Account. I received a letter for my local tax office indicating that they credited 2 cents per one hundred dollars of assessed property value as a credit toward my XX/XX/XXXX property tax payment. Wells Fargo failed to apply that credit to my XX/XX/XXXX property tax resulting in an over payment for XX/XX/XXXX. Although small, this amounted to {$88.00}. I received a escrow statement from Wells Fargo on XX/XX/XXXX which made no mention of the {$88.00} reduced payment or credit in my Escrow Account. I made two call to Wells Fargo who indicated they they have not record of a reduced tax payment from the local real estate tax office. By Wells Fargo saying that they are required to maintain an Escrow Account is false according to Lenders Handbook - XXXX XXXXXXXX XXXX which I cited above, and it appears that Wells Fargo is conducting predatory lending practice against veterans.
