In review of my credit report in XX/XX/XXXX I discovered a negative debt of XXXX owed to a company that I had never heard from or knowingly done business with, so I disputed the debt. A few weeks later I received an alleged debt validation letter in XX/XX/XXXX from a debt collector who purchased the alleged debt in XX/XX/XXXX. They claimed to have a debt owed by an original creditor that I ended service with in XXXX when I switched carriers. I have emails and chats showing I left XXXX in XX/XX/XXXX. The debt they allege I owed was from a date range XX/XX/XXXX. This was not a debt they verified, but they are still reporting on my credit reports. They violated the following Fair Debt Collection Practices Act 1692-1692p. : 809. Validation of debts ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- IT WAS 7 MONTHS AFTER THEY FIRST REPORTED RECEIVING THE DEBT. THEY BEGAN REPORTING TO THE CREDIT BUREAUS WAY BEFORE THE NOTICE EVER CAME. ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector : See ATTACHMENT THE ONLY LETTER RECEIVED DOES NOT SHOW ANY STATEMENT This was the first notification I had ever received by Source Regional Management for any debt. No reason was given for why they failed to notify me. 805. Communication in connection with debt collection Would hang up on me when I called to get more information because I refused to provide personal information to them. 807. False or misleading representations They claim that XXXX is a client in the validation later. Does not say they represent XXXX, or a law firm or anything else. Seems intentional by the debt collector. I called twice and needed to have clarity on how they think this debt is mine, but have not received consistent, clear or respectful communication with them. I had the right to say the debt was not mine and to not provide you with personal information. You were asked to further verify that this debt was mine and you hung up on me. They have no interest to reasonably resolve this professionally, so I filed this complaint.
