In XXXX of XXXX I re-financed and paid the car off to Exeter finance. They lost the payoff check. When found it was past the payoff date. I had tracking to prove that the check was received on XX/XX/XXXX before the payoff date of XX/XX/XXXX. A supervisor approved waiving the difference in the payoff/interest because they had misplaced the check. Fast forward to this year, XXXX. I am selling the car and no longer need the extended warranty. XXXX messed up and sent the refund to the old lienholder, exeter. Exeter is now taking out the amount they waived last year from this check they were never supposed to receive. They are also holding the check for a month before sending me the remaining balance. All phone calls and interactions have been recorded and they keep changing their story and now they claim they never lost the check last year but as a courtesy they waived what they waived but its their policy if they get money to unwaive anything they've waived. Unethical and Illegal. They were not supposed to receive it in the first place, the car and account has been paid off for over a year.
