FACTS : XXXX. I entered into a 36 month balloon promissory note with XXXX XXXX XXXX. XXXX loan number XXXX from XX/XX/XXXX maturing XX/XX/XXXX at fixed rate of 6.75 %. XXXX. I documented regular monthly payments from XX/XX/XXXX through XX/XX/XXXX. XXXX. Regular interest only payments were made for 12 months after the maturity date of the Note. XXXX. On XX/XX/XXXX, correspondence from XXXX indicates I requested XXXX to accept a Deed in Lieu of Foreclosure. XXXX. On XX/XX/XXXX, I and XXXX agreed to modify the mortgage and extend the maturity date to XX/XX/XXXX. XXXX. On XX/XX/XXXX, XXXX XXXXXXXX XXXXXXXX XXXX XXXX XXXX ) transferred the subject Deed of Trust from XXXX to XXXX XXXX. XXXX. From mid XXXX through XXXX of XXXX, I attempted to work out, renegotiate, short sale modify or seek deed in lieu of foreclosure from XXXX XXXX. Multiple correspondence indicates my providing requested financial information for loan workout. XXXX. On XX/XX/XXXX, XXXX XXXX returned the regular interest payment to me dated XX/XX/XXXX. Correspondence stated the balloon maturity date had passed, and payment in full was required within 30 days of the maturity date. NOTE ITEM XXXX ABOVE. The maturity date per the extension was XX/XX/XXXX. XXXX. I submitted no payments between XX/XX/XXXX and XX/XX/XXXX. XXXX. On XX/XX/XXXX I engaged attorney XXXX XXXX XXXX. Various communications were made attempting to work out the loan. Acceptable terms could not be reached between XXXX XXXX and me. XXXX. On XX/XX/XXXX, XXXX XXXX referred the loan to its counsel to initiate the foreclosure process. XXXX. On XX/XX/XXXX I was contacted by XXXXXXXX XXXX XXXX advising me they were initiating the foreclosure process. XXXX. During this time period, clients worked with XXXX XXXX XXXX XXXX XXXX. Credit reports indicated negative treatment, and loan refinancing could not be obtained. XXXX. On XX/XX/XXXX I paid in full the outstanding balance of {$180000.00} causing me pain and suffering. XXXX. On XX/XX/XXXX I corresponded with XXXX credit reporting agencies explaining the discrepancies with reports from XXXX XXXX. Negative credit reporting made me unable to conduct any financial dealings due to a ) impaired credit/credit scores and b ) increased debt to income ratio. XXXX. In an email dated XX/XX/XXXX, I provided an explanation of credit reporting which identified a HELOC loan. To XXXX XXXX, there were no other loans or accounts with XXXX XXXX, other than the subject loan. XXXX. On an Equifax credit report dated XX/XX/XXXX there are XXXX ( XXXX ) XXXX XXXX accounts noted. Of note are XXXX entries : a ) No. XXXX with XXXX XXXX of {$170000.00}, opened XXXX, XXXX. XXXX XXXX, XXXX ; transfer/sold ; Status-Paid as agreed ; and b ) No. XXXX with XXXX XXXX of {$170000.00} ; opened XXXX, XXXX ; closed XXXX, XXXX ; paid and closed ; Status-Over 120 Days past due. XXXX. On an Equifax credit report dated XX/XX/XXXX, page XXXX of the report indicates XXXX ( XXXX ) instance of " Negative Accounts ''. The following items are noted : a ) No. XXXX with High Credit of {$170000.00} ; Account is in the Open Accounts section of the report ; opened XX/XX/XXXX ; date of last payment XX/XX/XXXX ; date of XXXX delinquency XX/XX/XXXX ; account status XXXX Days Past Due ; b ) Under the Closed Accounts section of the report there are XXXX ( XXXX ) XXXX XXXX accounts ; and c ) No. XXXX with High Credit of {$170000.00} ; Account is in the Closed Accounts section of the report ; opened XX/XX/XXXX ; date of last payment XX/XX/XXXX ; account status " Pays as Agreed ''. XXXX. Account statements mailed to me changed from XXXX to XXXX XXXX forms as of XX/XX/XXXX. SUMMARY My last attempt to make a regular payment was via a check dated XX/XX/XXXX. This check was returned by XXXX XXXX on XX/XX/XXXX. The correspondence from XXXX XXXX demanded payment in full of the outstanding principal within XXXX days of the maturity date of the Note stated that the Maturity Date had already passed. The modification of the original Note with XXXX stated the Maturity Date as XX/XX/XXXX. This was a XXXX year extension beginning from XX/XX/XXXX. The account number referenced by XXXX XXXX is XXXX, and XXXX 's loan number was XXXX. It appears that XXXX added the " customer number '' of XXXX to preceed the XXXX loan number. According to the records theh loan was paid in full on or about XX/XX/XXXX. The single loan of {$170000.00} appears twice on the credit report. First it appears as a XXXX XXXX loan bearing XXXX.
