Consumer Narrative
I am a victim of identity theft and filed all necessary paperwork with your company in XX/XX/2023 that was required per the law. I have since then had to file another ftc and affidavit because you refuse to abide by the law and continue to allow purchased identity theft items on my credit report, which appears on my credit report, does not relate to any transaction ( s ) that I have made. It is the result of identity theft. It also includes violation of my consumer rights. If these Identity theft accounts were mine, I didnt give these companies the permission to report or sell any information you have on record. So because my rights and privacy is being violated. I am demanding you follow the law and remove/block any information that I have identified as being a result of identity theft. Again not later than ( 4 ) business days after the receipt of such information I have provided to you. [ Identify item ( s ) resulting from the identity theft that should be blocked, by name of the source, such as the credit card issuer or bank, and type of item, such as credit account, checking account, etc. ] Please block this information from my credit report, pursuant to section 605B ( USC 1681A ) of the Fair Credit Reporting Act, and send the required notifications to all furnishers of this information. Also section 605B ( USC 1681c-2 ) ( a ) Clearly states : a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. As you can see, it states from an alleged identity theft and it gives 4 items that must be summited to the credit agencies for identity theft. Not one of these items states a police report must be included. That within itself is in violation of my consumer rights. Therefore enclosed are the following : A copy of my Identity Theft Report from the FTC Report on record XX/XX/2023 and proof of my identity. Completed and Notarized Identity Theft Affidavit Copy of my Identification Proof of residence Again, Section 605B of the Fair Credit Reporting Act, which requires you to block the fraudulent information on my credit report resulting from identity theft within four business days and to promptly notify the furnisher ( s ) of that information. The accounts, collections and inquiries are listed on the next page and also listed in my FTC Report and Affidavit. This is not a request for an investigation. This is Identity Theft and by If by any reason you decide not to block or remove. I will be moving forward with a lawsuit for violating my FCRA and Comsumer Rights for each identity theft account listed.
