Regarding the complaint submitted to XXXX XXXX XXXX XXXX on XX/XX/XXXX you stated that, our office previously mailed out a notice of debt on XX/XX/XXXX prior to reporting this to his credit this notice was never receive by me, XXXX XXXX, because as reported in my last dispute on XX/XX/XXXX, you stated that the address that you had on file for me was an address listed at XXXX XXXX XXXX XXXX XXXX TX XXXX ; per your request, I verified my correct address as XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX with an attached XXXX and current utility bill. You stated that, as of XX/XX/XXXX our records indicate consumer contacted our office, our representative provided consumer the debt information, in which request validation of debt, that information was emailed to the consumer to the email provided I, XXXX XXXX, the stated consumer filed a second dispute with CFBP on XX/XX/XXXX and provided my current contact information, which included my email address, current address and phone number ; this information was provided to XXXX XXXXXXXX XXXX XXXX in hopes to resolve this inaccurate reporting ; however, I never received an email or any correspondence from XXXX XXXXXXXX XXXX XXXX, the only responses I have received from XXXX XXXXXXXX XXXX XXXXXXXX has been through my disputes filed with CFBP. You stated that, as the account was further reviewed, the original contract contains the consumers phone number that match the caller ID used to communicate to our office on XX/XX/XXXX. As stated, this information was provided to you in my previous contacts with XXXX XXXX XXXX XXXX this is not my debt and my information was fraudulently used and an Identity Theft Report was reported. I also requested that you send me a copy of the original contract verifying this information and I have not received any information from your company. You stated that, the original creditor was XXXX XXXX, account # XXXX, origination date XX/XX/XXXX and although the signature on the original contract is an electronic signature the ESIGN Act granted electronic signatures the same legal status as handwritten signatures. The ESIGN ACT also stated with consent to do business electronically, involved parties MUST AGREE TO CONDUCT TRANSACTIONS ELECTRONICALLY, this consent was never established due to I have no knowledge of this transaction or debt because this is not my debt and I have never done any business with XXXX XXXX or XXXX XXXX XXXX XXXX therefore this fraudulent electronic signature was not completed by myself. You stated that, there was no other contact with the consumer before or after that date, nor we have received a formal dispute submitted to our office. My original dispute through XXXX to XXXX XXXX XXXX XXXX was on XX/XX/XXXX as advised by CFPB to ensure that the complaint would be documented. I contacted XXXX and XXXX via telephone on XX/XX/XXXX and then submitted a second dispute on XX/XX/XXXX in response to a request made by your company. All documents request were uploaded in the CFPB portal and sent to your company and also mailed through the US Postal Service. You stated that, the account has been placed in negation queue. I am not interested in any negotiations with your company as this debt is not my debt and I am not responsible for this fraudulent activity and inaccurate reporting on my credit report. I would like this remove immediately.
