Per the FCRA, I am a federally protected consumer. According to the law, consumer reporting agencies are to exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. XXXX, XXXX, and Experian are classified as consumer reporting agencies, and I by definition am the Consumer. Pursuant to 15 U.S Code 6801, it is the policy of Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. XXXX XXXX XXXX per 15 U.S Code 6801 is defined as a financial institution ; of which I am sure the U.S. Department of Justice, the U.S. Department of Housing and Urban Development, the U.S Securities and Exchange Commission, and the Office of the Comptroller of the Currency [ would ] consider any information that this institution engaged in illegal credit practices before the end of the institutions next performance evaluation. XXXX XXXX XXXX is in violation of 15 U.S Code 1681a ( 2 ) ( A ) ( i ). See Exhibit A. XXXX XXXX XXXX is under the regulation of many laws and as previously mentioned one of those is the FCRA, which states the term consumer report DOES NOT INCLUDE any report containing information solely as to transactions or experiences between the consumer and the person making the report. Pursuant to 15 U. S Code 1681c ( a ) ( 5 ) the publishing of any adverse item of information should not be on any consumer report. It clearly states except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This is a violation as they are reporting these items without my permission. See Exhibit B for the account I, the consumer, am speaking of. 15 U.S Code 1681e states every consumer reporting agency shall maintain reasonable procedures designed to avoid violation of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title.
