Wayfair/ ( Comenity Bank XXXXBread Financial ) reported 30 days late on XX/XX/XXXX on all three credit reports which was incorrect. The item is inaccurate because payment was made on XX/XX/XXXX, 18 days later than the due date of XX/XX/XXXX Per the U.S. Code 15 1666b - Timing of payments - A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. The credit card company had not uploaded statements to my online account or sent them to my email or mailed to my home address since XX/XX/XXXX ( See attached screen print ), which is a violation of US code 15-1666b. Due to the non-mailing of statements the late payment reported in XX/XX/XXXX should be removed. I sent the company a certified letter by U.S. Postal mail on XX/XX/XXXX, however I never received a response. Federal law late payments should be reported on consumers report only if they are past due 30 days or more.
