Exp I am absolutely fed up with this companies willful noncompliance with consumer law. I am a victim of identity theft and my personal information has been mixed with my father who shares the same first, last, and middle initial as me to open fraudulent accounts. I sent this company documentation regarding this identity theft pursuant to 15 U.S.C 1681c-2. I requested that the account owned by XXXX be blocked and removed in XXXX business days. Upon receiving these documents, this company blocked my request stating that my request to block was made in error, or, my request to block information was based on a material misrepresentation, or, I knowingly obtained or should have known that I obtained possession of goods, services, or moneys as a result of XXXX or more of the transactions that I am seeking to block. However, none of those circumstances are remotely close to being true. I received additional information regarding this account directly from the creditor who owns the fraudulent account that I requested to be blocked and removed. This documentation consisted of a letter and a statement reflecting the charges made on this account. This company states that they sent a credit card to an address that I have never lived and the statement shows that the credit card was maxed out in under a week. It is OBVIOUSLY fraud. Someone spent half of the money on the card at retail stores and pulled the remainder of the credit limit off of the card using ATMs. I sent this new, relevant documentation directly to Experian along with the same documentation I sent to them on XX/XX/XXXX pursuant to 15 U.S.C 1681c-2 and the documentation was received by Experian on XX/XX/XXXX per XXXX XXXX XXXX I called Experian on a recorded line on XX/XX/XXXX at XXXX XXXX. I spoke with XXXX agent who said her name was XXXX XXXX. XXXX XXXX stated that she can not help me in the fraud department because I have to be paying extra money. I then was transferred to a rep named XXXX and requested he pulls the information I submitted and review it. XXXX states this dispute wasnt received until XX/XX/XXXX, however the XXXX tracking states this documentation was received on XX/XX/XXXX. He read the new documentation and agreed on the recorded line that this account is fraudulent and should be deleted. However, later that day. On XX/XX/XXXX, Experian sent me an email stating that they are again refusing to block and remove this account even after receiving documentation directly from XXXX that specifically states the card was sent to an address I have never lived at and a statement showing the same address at bottom left and reflecting the cards limit being completely wiped in XXXX days. This company has NO authority under 15 U.S.C. 1681c-2 ( c ) to decline the block and removal of this fraudulent account now that they have been provided this supporting documentation. How is this account being verified? How could I have been the one to open this account if the card was sent somewhere I have never lived? Furthermore, why would I max the card out in under a week and take half of the cards limit off at an ATM knowing the crazy fees that come from that. Also, why would I open an account with someone and never make a single payment and ruin my own credit score for XXXX That is just completely illogical to accuse someone of. I have displayed more than enough proof, Ive filed an FTC report, what more do I have to do? I am following the law as a consumer and this company is displaying a willful noncompliance with the FCRA and they are violating my rights as a consumer.
