XXXX, Since XXXX of XXXX, I have disputed the method of verification of a bankruptcy you furnished to my Transunion consumer report. I have disputed this item with both XXXX and Transunion directly, and have filed several CFPB complaints with supporting evidence against XXXX and Transunion. Time and time again XXXX submits to Transunion that the item is verified as accurate and is a matter of public record. I find XXXX response to me on XX/XX/XXXX and subsequent dates to be false, deceptive, and misleading. XXXX alluded to the fact that consumers do not have a right to privacy by referring to consumer reporting agencies as credit bureau seeming as though XXXX is reporting to a federal entity as the term bureau is defined as Bureau of Consumer Financial Protection per 15 USC 1681a ( w ). However, this is false as Transunion is a credit reporting agency, and consumers DO have a right to privacy per the Congressional Findings of 15 USC 1681, and a right to not have private consumer transactions made public by XXXX and Transunion. In your initial correspondence, XXXX also advised I contact the Bankruptcy Court directly if I believed something was wrong. I spoke with the US Bankruptcy Court of Western Washington and asked if the court had reported a bankruptcy to XXXX or Transunion, and I was told the US Bankruptcy Court does NOT report or furnish any information to credit reporting agencies. In another letter XXXX sent to me, XXXX admitted to utilizing PACER.gov and NOT the Bankruptcy Court to furnish bankruptcy information to Transunion. The public must pay to access cases/dockets on PACER.gov, so bankruptcy information is NOT as publicly accessible as XXXX and Transunion lead on. XXXX searched for negative information to defame my character and tarnish my credit reputation, illegally using my personally identifiable information ( Name, SSN, DOB ) to match to a bankruptcy on PACER.gov. XXXX then sent this information to Transunion to report to all creditors causing severe damage to my consumer report. Such actions can be seen as fraud as Transunion lists the US Bankruptcy Court of Western Washington as the furnisher on my consumer report when really the information came from a website. By these very actions alone XXXX and Transunion have committed aggravated identity theft per 18 USC 1028A ( a ) ( 1 ) and several FCRA violations. I never gave XXXX or Transunion my written authorization, consent, or permission to use my personally identifiable information in any transaction or written consent to furnish bankruptcy information, a direct violation of 15 USC 1681 ( b ) ( 2 ). If XXXX and Transunion have my written consent, please attach the document in the complaint response. XXXX, was registered by Transunion throughout the years of my countless disputes up until XX/XX/XXXX. It is clear Transunion uses deceptive tactics as it relates to consumer reporting, by registering XXXX to furnish stolen private consumer information to report back to themselves ; giving the appearance that an alternate company is furnishing the information in an attempt to evade treatment as a consumer reporting agency. Such a practice is a violation of 15 USC 1681x. XXXX and Transunions actions of noncompliance to the FCRA has caused me grave emotional and mental distress which I have had to begin medical treatment for, drastically altering my life. As such, this is Transunions and XXXX last chance to rectify my affairs and block and remove the bankruptcy from my consumer report. 30 days will be allotted to do so to avoid any future legal action for defamation of character, and emotional and mental distress. I have tried through countless disputes for years to resolve this issue peacefully.
