I am a victim of identity theft. On XX/XX/XXXX, the suspect opened credit card account XXXX with XXXXFORTIVA and accrued {$3500.00} in charges. I believe the suspect stole my mail, specifically a W2 tax form sent from my previous employer, from a mailbox located at address XXXX XXXX XXXX, XXXX, NY where I lived from XX/XX/XXXX through XX/XX/XXXX. I discovered this fraudulent account on XX/XX/XXXX as I was looking at my credit report and noticed this unfamiliar bank and delinquent account. As soon as I discovered the account, I called Fortiva to report the fraudulent account. I spoke with a representative in the Fortiva Fraud Department, XXXX, who advised that the account was opened using the XXXXXXXX XXXX XXXX XXXXXXXX address. I had not been living at this address for 2 years when this account was applied for and opened on XX/XX/XXXX. On XX/XX/XXXX, I reported this theft to the XXXX XXXX XXXX Precinct, XXXX XXXX, who advised that I needed a written statement from the bank with details and information used to open the account before he could file a police report. On XX/XX/XXXX, I sent Fortiva a letter of request for business records related to this fraudulent account, along with the FTC Identity Theft Report, my government issued proof of identity, the Fair Credit Reporting Act Section 609 ( e ), and a link to ftc.gov resource titled Businesses Must Provide Victims and Law Enforcement with Transaction Records Related to Identity Theft. It has been 30 days since I sent Fortiva the letter of request for business records related to this fraudulent account and the only correspondence I have received is an Affidavit of Fraud form to fill out and send back to them in order for them to investigate. My consumer rights have been violated and I demand resolution to have this fraudulent account removed from my credit files. I have taken steps to dispute this fraudulent account by reporting the fraudulent account to Fortiva, disputing the account with all three credit bureaus - XXXX, XXXX, and XXXX - filing a complaint with the XXXX, as well as the XXXX Police Department. Additionally, I have placed a freeze on my credit, set up fraud alerts, and added consumer statements with all three credit bureaus. This credit card account was opened fraudulently using my personal information without my consent or permission. I did not open or authorize this account. My credit report is showing incorrect information by claiming this credit card account under my identity. I demand that Fortiva, XXXX, XXXX, and XXXX absolve me of all charges on the fraudulent account and all activities associated with it, and that all appropriate steps are taken to remove information about this account from my credit files.
