Consumer Narrative
CC : Consumer Financial Protection Bureau ( CFPB ) CC : South Carolina Attorney General ( Complaint Filed ) CC : XXXX XXXX XXXX XXXX XXXX XXXX CC : Federal Trade Commission ( FTC ) CC : XXXX, Equifax, XXXX Dear XXXX FUNDING ( Original Creditor : 12 XXXX XXXX XXXX XXXX ) I am writing to dispute the charge-off that appears on my credit report for account XXXX. I believe that this charge-off was the result of multiple violations of federal law, including the Uninformed Decision Law ( 15 U.S. Code 1601 ( a ), the Lack of Evidence of Indebtedness Law ( 15 U.S. Code 1602 ( g ) ( 2 ), and the Adequate Notice Law ( 1643 of 15 U.S. Code 1602 ( k ). Therefore, I am requesting that it be removed from my credit report. Firstly, I was not properly informed of my rights and responsibilities under the Uninformed Decision Law. This law requires that creditors provide consumers with certain information, including the cost of credit and the consequences of non-payment, before they can legally charge off an account. I believe that I did not receive adequate information regarding my rights and responsibilities, and as a result, I made an uninformed decision. Such notice may be given to a cardholder by printing the notice on any credit card or honest on each periodic statement of account issued to the cardholder or by any other means reasonably assuring the receipt thereof by the card holder. Secondly, I have not received any documentation from the creditor showing that I owe the debt in question, which is a violation of the Lack of Evidence of Indebtedness Law. I am therefore unable to verify the accuracy of the charge-off. The only evidence of this debt was the agreement but the agreement, but that agreement was null and void because I made an uninformed decision, I did not understand this agreement and it was not clear and conspicuous. Lastly, I do not believe that I received adequate notice from the creditor regarding the status of the account, which is a violation of the Adequate Notice Law. I did not receive any communication or notification from the creditor regarding the impending charge-off, and I was not given an opportunity to rectify the situation before the charge-off occurred. Given these violations of federal law, I request that you investigate this charge-off and provide me with a detailed explanation of why it was reported. If it was indeed the result of violations of federal law, I ask that you remove it from my credit report. Thank you for your attention to this matter. I look forward to resolving this issue as soon as possible. Sincerely, XXXX XXXX
