I'm trying to sell my house and buy a new house to move. I've been looking for lenders for mortgage. Once I did hard pull with one lender, I've got to hear from this broker, XXXX XXXX ( aka XXXX XXXX ) from XXXX XXXX. He presented himself as a broker and I've got the estimate loan from him with the company called, XXXX XXXX under name with XXXX XXXX. XXXX and I have been communicating for getting lower rate, and since other lender was telling me that they can match the rate with XXXX 's once XXXX can lock the rate. I've checked with many lenders about estimates. I made sure they only do soft pull my credit and they always asked me before they proceed it. I denied when I didn't want to. XXXX gave me estimate loan as pre approval. And I asked him I only want soft pull for now. and he said it wasn't hard pulled for this pre approval. I bought a house once with my husband which I'm in process to sell. But mostly my husband proceed process with the realtor at that time so I would say this the first time I'm buying for myself and first experience buying a house because we are divorcing after this. Since I was notified from all other lenders for hard inquiry, I expected XXXX will let me know before he does. I asked XXXX if we can lock the rate since the other lender was asking if we can do. He only said yes!! He didn't inform me AT ALL!! about from now on XXXX needs to hard pull my credit or else. I already spoke with him that I'm not ready for hard pull inquiry until I make my mind. XX/XX/23, In the morning I realized my credit was pulled, XXXX credit report. When I spoke with XXXX afternoon, He did not tell me he did hard pull until I asked. He ONLY said, I asked for lock in rate and that means I gave him a permission to hard pull my credit. I said, I did NOT know locking in rate means I'm automatically giving you my permission to do so, and I already told you I'm being careful about being pulled! and XXXX accepted he didn't ask for my permission, and ASSUMED I asked for hard pulled. ALL LENDER MUST INFORM ALL OTHER BORROWERS BEFORE THEY PROCEED HARD INQUIRY, and I wasn't asked for my permission and I DID NOT GIVE XXXX PERMISSION and I even found out myself and had to ask if XXXX did!!!
