Under the Fair Credit Reporting Act ( 15 USC 1681 section 602 ( a ) ), it is essential that consumer reporting agencies such as Equifax and XXXX carry out their responsibilities with fairness, impartiality, and respect for consumers ' right to privacy. As a consumer, I am entitled to ensure the non-disclosure of my private information, as supported by 15 USC 6801, which states that financial institutions, including entities that furnish information to credit agencies, have an obligation to respect customer privacy and protect their nonpublic personal information. According to 15 USC 1681 section 604 ( a ) ( 2 ), consumer reporting agencies like Equifax and XXXX are only allowed to furnish consumer reports when provided with written instructions from the respective consumers. Neither the financial institution furnishing the information nor Equifax and XXXX have obtained my consent or written authorization to furnish my information. Therefore, any consent previously given, whether verbal, non-verbal, written, or implied, to Equifax, XXXX, and the financial institution furnishing the information, is hereby revoked. Furthermore, 15 USC 6802 ( b ) ( c ) states that a financial institution can not disclose nonpublic personal information to a nonaffiliated third party without providing the consumer an explanation of how they can exercise their right to nondisclosure. The financial institution has failed to inform me of my right to exercise this option. In addition, as per 15 USC 1681C ( a ) ( 5 ), consumer reporting agencies are prohibited from including adverse items of information in a consumer report, except for records of convictions of crimes that occurred more than seven years ago, unless authorized under subsection ( b ). The reporting of this account as an adverse item without my permission is a violation of the law. Moreover, under 15 U.S. Code 1681s2 ( a ) ( 1 ), it is prohibited to furnish any information to a consumer reporting agency if the person knows or reasonably believes the information to be inaccurate. Equifax and XXXX have not maintained reasonable procedures to prevent violations of Section 1681c and limit the furnishing of consumer reports to the purposes listed under Section 1681b. Finally, according to 12 CFR 1016.7, consumers have the right to opt out of reporting services at any time. I am exercising my right to opt out of your reporting services
